City Council authorized a Temporary Possession and Use Agreement for the West Texas Avenue Drainage Improvement Project

On Thursday, the City Council authorized a Temporary Possession and Use Agreement for the West Texas Avenue Drainage Improvement Project.

This proposed ordinance would authorize a Temporary Possession and Use Agreement for the property located at 407 West Pearce Avenue with Specialty Construction TX, LLC, for the West Texas Avenue Drainage Improvement Project.

Specialty Construction TX, LLC, was awarded the construction contract for the West Texas Avenue Drainage Improvements Project on October 24, 2024. The contractor inquired about the use of the City Property at 407 West Pearce Avenue for a storage / lay down yard for use during the construction of the project. City staff investigated this possibility and determined that it was practical and logical for the contractor to use this site. The purpose of this agenda item is to request City Council authorization of an agreement to allow the contractor temporary use of the site for the construction of the West Texas Avenue Drainage Improvement CIP Project.   

The property at 407 West Pearce Avenue will be used as a lay down yard for Specialty Construction TX, LLC, for storing construction materials, equipment, and supplies. This designated space will provide the contractor with a secure location to store construction materials, equipment, and supplies, ensuring these items are kept off the roadway. The project can maintain a safer, more organized work environment while minimizing disruptions to traffic and surrounding areas. Specialty Construction TX, LLC will be responsible for maintaining the property throughout the project, and will restore the property to its original condition or better upon completion. The Temporary Possession and Use Agreement shall commence on February 1, 2025, and expire on December 31, 2025.
